8:30 – 9:30 The EEOC’s New Focus on Systemic Discrimination: The EEOC has several new areas of focus, including systemic discrimination. More and more employers are surprised to find themselves the subject of systemic investigations. We will review the EEOC’s concerns about background checks, credit checks, testing, and other routine procedures that can lead to EEOC investigations and class action litigation.
9:30 – 10:30 ADA / FMLA Issues That Still Challenge Employers: This interactive discussion will review common problems and issues still faced by employers in administering the FMLA and the ADA, and specifically the overlap between the two. For example, we will explore the risks associated with terminating employees at the end of their FMLA, workers’ compensation leave, and similar leaves.

10:45 – 11:30 The Latest on Union Activity and the NLRB’s Impact on Non-Union Employers: The National Labor Relations Board is having a significant affect on non-union employers. For example, this Board has issued decisions affecting confidentiality policies, at-will policies, arbitration agreements, and other policies and procedures common in the non-union workplace. We will review those areas employers need to focus on. Additionally, this session will review strategies for union avoidance in the future.
11:30 – 12:30 Social Media – Should We Embrace It or Prohibit It?: Employers find themselves conflicted when sales and marketing promotes the use of social media, but other departments want to prohibit it. Additionally, learn how social media can create risks in the hiring process, investigations, and other daily workplace issues. We will review everything from privacy issues, federal laws on the subject, and practical tips on how you can help your company avoid liability.
12:30 – 1:30 Ask a Lawyer: Over lunch, Fisher & Phillips attorneys will entertain questions on employment related topics. These can be related to the presentations or on other issues. These speakers encourage you to arrive with questions in hand and prepared to engage in these interactive presentations.
